Fake Beef: What the Label Is Allowed to Mean

Almost nothing sold as beef in an American supermarket is a different animal. Species substitution is real, but it is rare in beef and it is covered on another page. The beef problem is quieter and much more common: the package really does contain beef, and almost every other thing you believe about it — that the brand identifies who made it, that the price tracks the quality, that “natural” describes the farm, that the colour tells you how fresh it is — is either unregulated, actively misleading, or true only of a word you were not looking at.

This page is about that gap. It sets out what each phrase on a beef package is legally required to mean, who if anyone checks it, which of the differences are worth paying for and which are decoration. Four things are printed on every federally inspected package, and only one of them is difficult to market.

What This Page Covers, and What It Does Not

This section of the site runs several pages on meat, and they divide the subject deliberately.

The distinction matters because the two problems have opposite shapes. Substitution is rare, dramatic, and detectable in a laboratory for a few dollars. Claim fraud is routine, boring, and in most cases not detectable at all — there is no assay that can look at a steak and tell you whether the animal ate grass, because for most of the relevant claims the beef is chemically the same either way. What is being sold is a history, and a history leaves no residue.

One more boundary. This page does not tell you which brands to buy. Brand recommendations rot within a season, and — as the next section shows — the brand is structurally the least informative thing on the package. The aim is to leave you able to read any package, including ones that do not exist yet.

The Recall That Explains the Whole Problem

In January 2022 an Oregon grinding establishment recalled approximately 28,356 pounds of ground beef after a retail package, bought by a consumer organisation and sent to an independent laboratory, tested positive for Escherichia coli O157:H7 — the Shiga toxin–producing strain that causes haemolytic uraemic syndrome, the form of acute kidney failure that disproportionately harms young children. The product had been made on a single day in December 2021 and shipped to seven states.

The interesting part is not the pathogen. It is the recall list. The affected product was sold under the store brands of four separate national grocery chains, at four different price points, in four different packages. All of it carried one establishment number, because all of it came out of one grinder in one building on one day.

This is not an anomaly, and it is not a scandal in the sense of somebody having broken a rule. It is how the supply chain is built. A grinding plant supplies many retail customers; each customer applies its own brand, its own packaging design and its own pricing strategy; the meat is the same meat. Federal epidemiologists have documented the same structure from the other direction, tracing two simultaneous multistate outbreaks of Shiga toxin–producing E. coli back to beef from a single slaughter facility that had reached consumers through unrelated brands.

Draw the conclusion carefully, because it generalises well beyond recalls: the brand tells you who sold it, not who made it. If you paid more for one of those four packages than for another, you did not buy different beef. You bought a different box. The one printed element that could have told you they were the same product is the establishment number, and it is set in the smallest type on the label.

The Four Things Printed on Every Package

Federally inspected meat carries four independent pieces of information. They are worth separating because each one fails in a different way, and a package can be scrupulously honest about three of them while the fourth carries the entire marketing burden.

  1. The name. Not the brand and not the photograph — the legal product name, which determines what may lawfully be in the package.
  2. The number. The establishment number inside or beside the USDA mark of inspection, which identifies the plant.
  3. The claim. Every raising, welfare or environmental phrase, and critically whether a certifier's seal sits next to it or not.
  4. The origin. What the words “Product of USA” are now required to mean, which changed at the start of 2026.

Each of the next sections takes one corner. The order matters: the name constrains the contents, the number identifies the maker, the claim describes the animal's life, and the origin describes its geography. A package can be upgraded on any one of them without touching the others, which is exactly what premium pricing usually consists of.

Corner One: Three Legal Products, Three Different Rules

Beef in a tray is sold under several names that shoppers treat as synonyms. They are not synonyms. They are three distinct standards of identity, set out in the Code of Federal Regulations at 9 CFR 319.15, and the differences between them are substantial.

Ground beef (also “chopped beef”)

Chopped fresh and/or frozen beef, with or without seasoning. Beef fat may not be added as such. Fat may not exceed 30 per cent. It may not contain added water, phosphates, binders or extenders. That is the whole permitted contents list.

Hamburger

The same product with one difference: beef fat may be added as such. The 30 per cent fat ceiling still applies, and added water, phosphates, binders and extenders are still prohibited. So “hamburger” on a label is not a downgrade in the way people assume — it is a near-identical standard that permits fat trim to be blended back in.

Beef patties

A materially different product. Beef patties may lawfully contain binders or extenders, partially defatted beef fatty tissue, and added water, provided the result still has the characteristics of a meat patty. Every protection the first two standards give you is written out of this one.

A note on precision, because this is a place where quoting the regulation without reading around it produces a false impression. The text of the beef-patty standard also refers to mechanically separated species material. For beef that clause does not operate: following the December 2003 domestic BSE case, the Food Safety and Inspection Service prohibited mechanically separated beef from human food in January 2004, because the process could carry central nervous system tissue. So the honest version of the beef-patty warning is about binders, extenders, partially defatted fatty tissue and water — which is quite enough — and not about mechanically separated beef, which is not permitted in your food at all.

The practical consequence is small and completely actionable. Two words on the front of a box decide whether the contents are legally restricted to beef and seasoning or legally open to water and filler, and those two words are almost always printed smaller than the brand, smaller than the photograph, and smaller than the price. Read the product name before anything else. If you want preformed patties without the wider ingredient permissions, the front of the pack has to say ground beef or hamburger — those are the protected terms, and “patties” is not one of them.

Corner Two: The Establishment Number

Inside the circular USDA mark of inspection, or printed beside the time stamp and the use-or-freeze-by date, is a short code: the letters EST followed by a number. It identifies the federally inspected establishment that produced the product. It is assigned by the government, it cannot be chosen for its marketing value, and it is the only line on the package that no brand department had any say over.

Everything else on the front is a decision someone made about how the product should appear. The establishment number is a fact about where it physically came from. That asymmetry is why it is worth the effort of finding, and it is why the January 2022 recall could be described in one line: one number, four brands.

Two honest limitations, because this is often oversold.

The useful test is not really about decoding the number at all. It is about who will tell you it. A producer that publishes which facility processes its beef, or will answer the question when asked, has volunteered the one piece of information the industry generally leaves in four-point type. That is a meaningful signal even before you know anything about the facility itself.

Why Ground Beef, and Not Steak, Is What Gets Recalled

Look at recall notices over any few years and ground beef appears far out of proportion to its share of the meat case. There is a structural reason, and it is the single most useful thing to understand about this product.

A steak is one muscle from one animal. Whatever is on it is on the surface, and searing the surface handles it. Ground beef is an assembly. Trim from many carcasses is combined, blended to hit a target lean-to-fat ratio, and pushed through a grinder that distributes whatever was on any surface throughout the entire batch. Two things follow. The number of animals contributing to a given package is large, and the contamination that would have stayed on the outside of a steak is now in the middle of a patty.

How large is “large”? Published estimates range from dozens to well over a hundred animals per industrial patty. The most careful attempt to pin the number down — a 2015 newspaper investigation that pursued it through the supply chain — concluded that it could not be established with confidence, because the blending records are not public and the answer varies by plant, by day and by product. Treat any single confident figure with suspicion, including the widely repeated “more than a hundred.” The defensible statement is the one that actually matters: one pound of commodity ground beef represents many animals, each one an independent opportunity for contamination, which is precisely why the risk arithmetic of ground beef differs from that of whole muscle.

This also explains why recalls sprawl across brands and states. A contaminated lot is not one animal's worth of meat. It is a production run, and production runs are distributed widely before anyone tests anything.

Ground In-Store: The Honest-Looking Choice

Meat ground at the back of the shop feels like the answer. It is local, it is visible, someone in an apron did it this morning. It is worth being precise about what it actually is, because the intuition is half right and half backwards.

What is genuinely better: the supply chain is short, and the product is fresh in the literal sense.

What is not: federal inspection covers processing establishments. A grinder running behind a retail counter is generally operating under state or retail-exempt arrangements rather than as a federally inspected establishment, which is why there is often no establishment number to find. And in-store grinding does not reduce the number of animals in the tray — it usually combines trim from multiple cuts, multiple animals and often multiple suppliers, then runs it through equipment that is cleaned on the shop's own schedule rather than a federally prescribed one. Food-safety investigators have traced E. coli O157:H7 outbreaks specifically to beef ground on the premises, so this is a documented pathway and not a theoretical one.

There is, however, a genuinely excellent move available at that same counter, and it costs nothing. Ask for a whole cut — a chuck roast is the usual choice for burgers — to be ground for you while you wait. Most counters will do it, and most will not charge extra. You have then gone from an unknown number of animals to one cut of one animal, with a grinder you saw cleaned or at least saw used. Measured against everything else on this page, that is the largest single reduction in uncertainty available to an ordinary shopper, and it takes about ninety seconds.

Corner Three: A Word With a Seal, and a Word on Its Own

Raising claims are where the money is. They are also where the gap between what a phrase promises and what anyone verifies is widest. There is one distinction that does most of the work, and it is visual rather than verbal.

A claim with a certifier's seal beside it went through an inspection. A claim standing on its own went through a marketing department.

That is not cynicism about the words, several of which are meaningful when they are substantiated. It is a statement about who checked. Under United States practice, most animal-raising claims are substantiated by documentation the establishment submits when the label is approved — the claim must not be false or misleading, and the establishment has to be able to support it, but routine on-farm verification by a third party is not built into the process unless the producer has chosen to buy it.

The Food Safety and Inspection Service addressed exactly this in an updated guideline issued on 28 August 2024. It strongly encourages third-party certification for animal-raising and environment-related claims, on the stated reasoning that independent verification is what keeps such claims truthful and not misleading. Note the verb. A guideline is not a regulation; the document says so on its face, and establishments are not obliged to follow it. Animal-welfare organisations submitted during the consultation that certification should be required rather than encouraged, and it was not.

So when you are looking at two packages both printed with the same appealing phrase, the words are not the variable. The seal is.

“Natural” Describes the Factory, Not the Farm

This is the most purchased reassurance in the meat case and the most misread word on this page. For meat and poultry the term has a definition, it is short, and reading it once is usually enough to stop paying for it.

A meat product may be labelled natural if it contains no artificial ingredient or added colour and is only minimally processed — processed in a way that does not fundamentally alter the product. Labels using the term are expected to explain what is meant by it, for example “no artificial ingredients; minimally processed.”

That is the entire content. Now consider what it does not touch:

Fresh, unseasoned beef with nothing added to it satisfies the definition automatically. The word is therefore true on the overwhelming majority of plain beef packages and distinguishes none of them from each other. It is a claim about what happened after the animal died, printed in a typeface that invites you to read it as a claim about how the animal lived.

The claims that do carry farm-level meaning, and are audited, are USDA Organic and the third-party grass-fed and welfare certifications discussed next. Treat “natural” standing alone as decoration.

Grass-Fed: The Standard the Government Withdrew

Most shoppers assume there is a federal definition of grass-fed beef. There was one. It was taken away, and the reason it was taken away is more interesting than the fact.

On 12 January 2016 the Agricultural Marketing Service withdrew its Grass (Forage) Fed Marketing Claim Standard. The agency's position was not that the standard was wrong but that it lacked the authority to set it: without express authority from Congress — of the kind that underpins the National Organic Program — it could not define labelling standards or adjudicate whether marketing claims were truthful and not misleading. The standard was withdrawn as not usefully serving stakeholders or consumers.

What filled the space is the honest answer to “who defines grass-fed now?”, and it needs stating carefully because both simplifications in circulation are wrong. It is not true that the term is federally defined. It is also not quite true that a company may print whatever it likes: a label claim must still be approved, and the establishment must hold documentation supporting it. What is missing is a single authoritative definition of the words and any routine independent check that the documentation reflects what happened in the field. In practice the operative definition is whichever one the producer has adopted — which may be rigorous, and may be “this animal ate grass at some point.”

Independent certification is what restores the meaning. The American Grassfed Association standard requires a 100 per cent forage diet from weaning to harvest, no confinement feedlots, no antibiotics, no added hormones, United States family farms, and on-farm inspection on a recurring cycle. Certified Grassfed by A Greener World is a comparable independent programme. Each publishes its standard, so you can read what the seal actually certifies rather than inferring it.

Raised Without Antibiotics: Two Studies, One Answer

This is the claim that commands the largest premium and has the widest gap between promise and verification. It is also the one place on this page where the evidence is strong enough to be worth setting out in detail, because two independent investigations — one adversarial, one governmental — reached the same conclusion by different routes.

The independent study

In April 2022 researchers at the George Washington University published a policy analysis in Science reporting results from a market-sampling programme. Urine was collected at slaughter from roughly 700 cattle, drawn from 312 lots across 33 feedyards certified for the raised-without-antibiotics market, and screened with a rapid test covering seventeen antibiotics commonly given in feed and water. Forty-two per cent of the feedyards had at least one animal test positive. The lots containing at least one positive represented approximately fifteen per cent of the raised-without-antibiotics cattle processed during the study window.

The industry objections were reasonable ones: a limited sample, a single snapshot, and urine rather than tissue as the matrix.

The government's own study

Those objections were then tested directly. Beginning in 2023 the Department of Agriculture ran its own investigation, published in the Journal of Agricultural and Food Chemistry in January 2025. Inspectors randomly collected kidney and liver tissue from 189 animals designated raised-without-antibiotics, across 79 slaughter establishments nationwide, and screened the samples for 185 veterinary drugs, repeatedly and by two different mass-spectrometry platforms.

Thirty-seven animals — 20 per cent — met the identification criteria for at least one antibiotic confirmed in at least two separate analyses. Eleven animals carried more than one. Macrolides were confirmed in 20 animals (11 per cent), tetracyclines in 12, the ionophore monensin in 11, with single findings of a sulfonamide and of penicillin G metabolites. The tissue study did not soften the urine result. It came in higher.

What this does and does not mean

Three qualifications belong here, and leaving them out would be the same kind of selective presentation the page is arguing against.

What remains after the qualifications is the point. Two independent efforts, using different matrices and different analytical methods, found the same order-of-magnitude failure rate in a claim that carries a substantial price premium and is not routinely tested. The reason anyone knows this is that two groups went and measured. Nobody is measuring on your behalf at the register, which is the argument for the seal rather than the word — a certified programme at least commits someone to going and looking.

Corner Four: What Changed on 1 January 2026

For years “Product of USA” on a meat package meant something close to nothing. An animal could be born abroad, raised abroad and slaughtered abroad; if the meat was repackaged or further processed in the United States, the label could lawfully be applied. The words described the last step, not the life.

That changed. The Food Safety and Inspection Service published a final rule, Voluntary Labeling of FSIS-Regulated Products With U.S.-Origin Claims, on 18 March 2024, with a compliance date of 1 January 2026. Under it, “Product of USA” and “Made in the USA” may appear on a single-ingredient meat or poultry product only if the animal was born, raised, slaughtered and processed in the United States. For multi-ingredient products every regulated component must meet the same test, all other ingredients apart from spices and flavourings must be domestic, and the preparation must have happened in the United States.

Two things to hold together, because the change is genuinely useful and routinely overstated.

Establishments had until the compliance date to bring labels into line or drop the claim, so packages printed under the old rule have been working through the system. From 2026 onward, an origin claim is one of the few phrases in the meat case that means what a shopper would assume it means.

Colour Stopped Being Information

Two things are true about the colour of beef, and the popular internet version has them the wrong way round.

Grey in the middle is normal

The pigment responsible is myoglobin, and it exists in three states. Without oxygen it is deoxymyoglobin, which is purplish-red — this is the natural colour of the interior of a piece of meat, and of any surface that has not met air. On exposure to oxygen it converts to oxymyoglobin, the bright cherry red of a freshly cut surface; this is called bloom. With prolonged oxidation it becomes metmyoglobin, which is brown.

So opening a package and finding red on the outside and dull grey-purple in the middle is textbook chemistry, not spoilage. The interior simply has not met air. A great deal of sound beef is discarded every year on the strength of videos that mistake the normal state of the pigment for decay. Spoilage announces itself by smell and by a sticky or slimy surface, not by the colour of the middle.

Red on the outside can be manufactured

The genuine problem runs in the opposite direction. Since 2002 the use of low concentrations of carbon monoxide — below 0.4 per cent — in modified-atmosphere meat packaging has been treated as generally recognised as safe in the United States, initially in secondary or master packaging and from 2004 in primary packaging flushed directly into the retail tray. Carbon monoxide binds myoglobin to form carboxymyoglobin, which is a stable bright cherry red and does not readily convert to the brown of metmyoglobin.

The European Union took the same evidence and did not authorise the practice for meat, the stated concern being that a stable cherry colour can persist beyond the product's microbial shelf life and therefore mask spoilage from the consumer. Norway, which had used carbon monoxide packaging routinely since 1985, discontinued it in 2004 under pressure from European trading partners.

Reasonable people disagree about whether the practice is a safety issue; the research literature is largely reassuring on toxicology and largely unresolved on the masking question. But the consumer conclusion does not depend on settling that argument. A bright red surface may be a fresh surface, or it may be a packaging gas. The eye can no longer distinguish the two, so the eye is no longer doing useful work. Shop the date and the establishment number instead, and if you want colour to be informative again, buy it frozen from a producer who ships direct, or buy it ground in front of you.

Lean Point, Fat Cap and Grade

Three numbers appear on beef packaging and they measure different things. Conflating them is common and costs money.

The lean point — 80/20, 85/15, 93/7 — is a fat ratio, nothing more. It is a compositional statement about the blend, not a quality statement about the animal. A 93/7 package is leaner; it is not better beef, and for a burger it is usually worse eating.

The 30 per cent ceiling is regulatory. Ground beef and hamburger may not exceed 30 per cent fat, which is why you will not see a lean point below 70/30.

The quality grade — Prime, Choice, Select — is a carcass assessment, based principally on intramuscular marbling and physiological maturity, applied to whole-muscle cuts. It is voluntary and paid for by the packer. It is largely beside the point for ground product, which is assembled from trim across the grading spectrum. If a ground beef package leans on a grade name, read it as brand language rather than as the carcass grade doing the work it does on a steak.

A separate word appears on lean claims: partially defatted beef fatty tissue, permitted in beef patties. It is fatty tissue from which some fat has been rendered out, used to adjust the fat content of a formulation. It is legal, it is disclosed in the ingredient statement, and it is one of the specific things the ground-beef standard of identity excludes and the beef-patty standard permits — which is the same point as the first corner, arriving from the ingredient side.

What Industry Concentration Does and Does Not Tell You

United States beef packing is unusually concentrated. The four largest packers account for roughly four-fifths of fed-cattle slaughter — the figure moves year to year and has been reported recently at both 81 and 85 per cent, so it is worth checking the current Packers and Stockyards data rather than quoting a remembered number. For historical scale: the same four-firm share was around a quarter in the late 1970s and had passed seventy per cent within about fifteen years. The structure has been broadly stable since the early 1990s.

This is the section where consumer-advice material usually goes wrong, so here is the disciplined version.

What concentration explains: why the same meat reaches you under many brands; why one plant's bad day becomes a seven-state recall; why price differences between retail brands frequently reflect packaging and positioning rather than the product; and why the establishment number is informative in the first place. It is the mechanism behind the opening story on this page.

What concentration does not tell you: anything about the contents of the package in your hand. A concentrated industry is not the same as a contaminated one, large plants are not inherently less hygienic than small ones, and the periodic antitrust disputes in this sector concern pricing and competition rather than food safety. Those are real matters of public policy and they belong to a different argument. Importing them into a shopping decision produces the specific error this page exists to avoid: treating a true statement about an industry as though it were information about a product.

Grass-Finished and Grain-Finished, Honestly

Having spent several sections on why the grass-fed claim is weakly verified, it is only fair to ask what the claim is worth when it is true. The answer is real but smaller than either camp says.

Finishing system reliably changes the fat. Grass-finished beef is typically leaner overall, carries a higher proportion of omega-3 fatty acids and a lower omega-6 to omega-3 ratio, and tends to be higher in conjugated linoleic acid and in fat-soluble compounds that come from forage, including vitamin E and the carotenoids that give the fat a faintly yellow cast. Grain-finished beef carries more total intramuscular fat, which is what marbling is and what the quality grades reward.

Finishing system changes the protein and minerals very little. Beef is a dense source of complete protein, highly bioavailable heme iron, zinc, selenium and vitamin B12 in either system, and the differences in those are small next to the difference a portion size makes.

The honest summary: the absolute quantities involved in the fatty-acid differences are modest against dietary intake as a whole, so grass-finishing is best understood as a genuine but incremental nutritional improvement, alongside welfare, land-use and flavour considerations that many buyers weigh more heavily. Which loops back to the labelling point. If you are paying a premium for the fatty-acid profile, what you need is a finishing guarantee — forage from weaning to harvest — and that is a certification, not an adjective.

The Kitchen Step That Outranks Every Label

This belongs on the page because consumer-advice material on beef routinely omits it, and it is more consequential for your household than any claim discussed above.

Because grinding distributes surface bacteria throughout the batch, ground beef has to be cooked through in a way that whole muscle does not. The United States guidance is explicit and the two numbers are different:

Colour is not a doneness test either — the same myoglobin chemistry that makes a raw interior grey can make a cooked patty brown before it is hot enough, or leave it pink after it is safely past temperature. A thermometer costs less than one premium package of beef and settles the question permanently.

Note how this interacts with the rest of the page. If you have had a single cut ground for you at the counter, the whole-muscle risk profile is much closer to what you are actually eating, and the argument for a rare burger is stronger — but the ground-beef temperature is still the guidance, because the grinder itself is part of the pathway. If you are buying commodity ground beef representing many animals, the temperature is not negotiable. A thermometer does more for a family's actual risk than every certification on this page combined; the certifications are about what you are buying, and this is about what reaches the table.

What a Shopper Can Actually Do

In rough order of how much difference each one makes.

  1. Own a meat thermometer and use it. 160 °F for ground, 145 °F plus a three-minute rest for whole muscle. Nothing else on this list affects your household's actual risk as much.
  2. Ask the counter to grind a single cut for you. A chuck roast, ground while you wait, usually at no extra cost. It collapses the number of animals in the tray from many to one.
  3. Read the product name before the brand. Ground beef and hamburger are protected terms with no added water, phosphates, binders or extenders. Beef patties is a different standard that permits all of them.
  4. Look for a seal, not a word. Certified grass-fed programmes and USDA Organic involve an inspection. An unaccompanied adjective does not.
  5. Ignore “natural” entirely. It means no artificial ingredients and minimal processing. Plain beef satisfies it automatically.
  6. Stop shopping by colour. Grey in the middle is normal chemistry; bright red on the outside may be a packaging gas. Use the date instead.
  7. Find the establishment number once, so you know where it lives on a package. Then use it the way it is actually useful: to check a recall notice, and to notice when two differently priced packages carry the same code.
  8. Prefer producers who will tell you where it was processed. Volunteering that information clears a bar most of the market does not.
  9. Treat “Product of USA” as meaningful from 2026 onward — but remember its absence means nothing, because the claim is voluntary.
  10. Buying direct — a local farm, a farmers' market, a producer who ships frozen — substitutes a conversation for a label. You can ask what the finishing diet was, when the animal was processed and where. No package answers those questions, and a person can.

The Bottom Line

Beef fraud in the United States is mostly not about what is in the package. The meat is beef. The fraud, where there is one, is in the story attached to it: a brand implying a producer, a price implying a grade, an adjective implying an inspection, a colour implying a date.

The defence is not suspicion, which is exhausting and mostly misdirected. It is knowing which printed elements are constrained and which are free. The product name is constrained by a standard of identity. The establishment number is assigned by the government. The origin claim, since the start of 2026, has to be true if it is made at all. A certification seal commits a named organisation to an audit against a published standard. Those four are load-bearing.

Everything else on the front of the package — the brand, the photograph, the farm imagery, the unaccompanied adjective — is a design decision. It is not dishonest by default, and some of it is backed by genuinely good practice. It is simply not evidence, and the moment you stop reading it as evidence the meat case becomes a much simpler place.

Beef is a genuinely nutrient-dense food and there is no good reason to be frightened of it. The argument of this page is narrower and more practical: read the four constrained elements, use a thermometer, and ignore the rest.
